Professor of the Law Faculty of the “JOHANNES KEPLER” University of Linz (Austria), Assoc. Prof. Dr. Stefan Schumann held an online lecture for the students of the UIBM Faculty of Law

The students of the Faculty of Law of UIBM had the opportunity to follow the online lecture organized by the management of the Faculty of Law of the “Isa Boletini” University in Mitrovica, with Assoc. Prof. Dr. Stefan Schumann from the Department for Corporate Criminal Law and Criminal Justice Institute for Criminal Law JOHANNES KEPLER UNIVERSITY LINZ, (Attorney (Rechtsanwalt), Munich), on the topic: “Fighting White Collar Crime – What Works? Insights into Corporate Criminal Liability, Forfeiture and Some Procedural Challenges”!

Professor Schumann, expert in criminal law, European law, comparative law (Corporate criminal law, criminal procedure law, commercial criminal law, medical criminal law, legal assistance and European criminal law), in this lecture was focus on the domain of criminal offenses so-called “white collar crime”, which are committed by and against corporations. Students were further informed about:

the main criminal offenses against the economy and corruption, found in the Austrian Penal Code (KPA) as well as in other Austrian criminal laws;
the transfer of criminal offenses of financial reporting to KPA (2016);
administrative sanctions;
financial crimes in the financial criminal code;
corporate criminal liability;
implementation of relevant legislation,
The specialized Public Prosecutor’s Office for criminal offenses against the economy and corruption, established in 2006;
generally on the trend towards decriminalization accompanied by a wide range of mitigations, due to active repentance as well as through the diversion procedure;
the Austrian model of corporate criminal liability;
the difference between individual criminal offense and corporate criminal responsibility,
breach of corporate obligations or obligations in favor of the corporation;
criminal liability (willful negligence);
types of crime, focusing on corporate criminal procedures, etc.
Interest in this topic was also shown by the students of the UIBM Faculty of Law, who held a professional debate with professors Schumann and Qerimi about the issues they needed to be informed about with concrete data from the infrastructure of Austrian and Kosovar legislation.

At the end of this lecture, Dean Qerimi collegially thanked Professor Schumann for his expressed willingness to conduct this very current lecture for both European countries (Austria and Kosovo), especially for the students of the UIBM Faculty of Law. Austrian Professor Schumann gladly accepted the invitation of Dean Qerimi, so that in the near future (in 2023) they deepen the forms of academic and professional cooperation between the two Faculties as sister Universities: “Isa Boletini” in Mitrovica (Kosovo) and “Johannes Kepler” of Linz (Austria).
